Referral Program Terms

The referral program is not open yet. These terms describe how it will work and apply from the day it opens.

1. About the program

The DataGuys.co LLC (“DataGuys”, “we”) referral program lets our customers earn a commission when a business they send our way buys from us. These Referral Program Terms (“Referral Terms”) apply in addition to our Terms of Service, Acceptable Use Policy and Privacy Policy. By joining the program you agree to them.

2. Who can refer

• You need a DataGuys account with a confirmed email address, and you must accept these Referral Terms.
• Our team reviews new referrers. Customers who have not yet paid us for anything stay pending until we approve them, and we may decline or remove any referrer at our discretion.
• One referral account per person or business. You may not refer yourself, your own business, a business you own or control, or anyone buying on your behalf, including through a second email address or account.

3. How a referral is credited

• Your personal link (dataguys.co/r/your-code) sets a cookie in the visitor’s browser that lasts 60 days. If that visitor then checks out, pays an invoice, contacts us through a form or creates an account, we record them as your referral. If they reach us by phone or email instead, they (or you) can tell us your code.
• The first live referral wins. If someone else’s referral for the same customer is already in place, a later click on your link does not replace it.
• A referral expires if the customer does not buy within 60 days of their most recent contact through your link.
• Once the customer makes their first qualifying purchase, the referral is locked to you.
• New customers only. Someone who has already paid us, or who was already in touch with us before your referral, does not count.
• Where it is unclear who referred a customer, or a referral looks irregular, we decide how it is credited. Our decision is final.

4. What earns a commission

You earn 10% of a referred customer’s first qualifying purchase. When a website build from that purchase is paid in two halves, the second half counts too. A qualifying purchase is a paid order with a commissionable amount above zero. Commission is calculated on what we actually keep, which excludes:

• domain registrations, transfers and renewals;
• anything refunded, credited back or charged back;
• pass-through costs we collect on the customer’s behalf, such as advertising spend;
• taxes and payment processing fees where they are charged separately;
• recurring charges collected automatically by a card subscription.

The rate that applies is the one in force when the qualifying payment is made. We may agree a different rate with an individual referrer in writing.

5. Holds and approval

Every commission is held for 45 days after the payment so that refunds and chargebacks can settle. Some commissions are held for longer:

• payments made by bank transfer, cash, Cash App or another manual method, until we have confirmed the money;
• website build deposits, until the build is paid in full; and website builds, until the site is delivered;
• payments under a card dispute, until the dispute is closed;
• cancelled orders and anything our team flags for review.

After the hold, our team reviews and approves each commission before it can be paid.

6. Refunds, chargebacks and reversals

If a referred purchase is refunded, cancelled, charged back or otherwise reversed, the commission on it is reduced or reversed to match. If it has already been paid, the difference is deducted from your future earnings. If your future earnings do not cover it within 90 days, you agree to repay it within 30 days of our request.

7. Payouts

• We pay approved commissions once your approved balance reaches at least $25.
• Payouts are made by PayPal, Cash App or account credit, to the details you give in your account. We aim to pay approved balances monthly. Account credit is applied as a discount on your next DataGuys invoice and has no cash value.
• When payout details change we email the account address, and we may hold the next payout for up to 7 days to confirm the change.
• You are responsible for giving us correct payout details. We are not liable for a payout sent to details you supplied.

8. Taxes

Commissions are income to you and you are responsible for any taxes on them. Where U.S. tax rules require it, we will ask for a completed Form W-9 before paying you and issue a Form 1099. We may withhold payouts until we have the information the law requires.

9. How you may promote DataGuys

• Disclose the relationship. Whenever you share your link or recommend us, make clear that you earn a commission if they buy, as the U.S. Federal Trade Commission requires.
• No spam. Only send your link to people who have agreed to hear from you, follow anti-spam law (including CAN-SPAM) and our Acceptable Use Policy.
• No brand bidding. Do not bid on “DataGuys”, dataguys.co or close variations in search or social advertising, and do not register domains or accounts that use our name.
• Do not post your link on coupon, cashback or deal sites, offer the customer a cash rebate, or make claims about our prices, discounts or services that we have not made.
• Do not present yourself as DataGuys staff or as acting for us. You are an independent referrer, not our employee or agent.

10. What you will see

Your Referrals page shows your link, how many people opened it, how many customers you have referred, and for each commission the month, the amount and its status. We also email you when a referred customer’s payment earns you a commission. To protect our customers, we never show you who bought or what they bought. Because you see the commission amount and when it arrives, you may be able to work out roughly what and when a referred customer spent; our Privacy Policy tells customers this.

11. Suspension, changes and ending the program

• We may disable a referral account for any breach of these Referral Terms, for abuse or fraud, or if we suspect it. Commissions earned through a breach are forfeited, and paid ones must be repaid.
• We may change or end the program, or these Referral Terms, at any time. We will update the date at the top of this page and, for material changes, email active referrers. Commissions on orders paid before a change or the end date are honoured under the terms in force when the order was paid.
• The program has a single level: you earn on customers you refer, not on customers referred by your referrals.
