1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and DataGuys.co LLC (“DataGuys”, dataguys.co), a global provider. By creating an account, placing an order, or using any DataGuys service, you agree to these Terms. If you are purchasing on behalf of a business, you represent that you have authority to bind that business.
2. Services we provide
DataGuys provides web hosting (shared, managed WordPress, semi-dedicated, and VDS), domain name registration services, professional email, website security products (SSL, firewall, malware protection, backup), online marketing services, and custom website design. The specific resources, limits, and features of each product are described on our site at the time of purchase and in your order confirmation.
3. Your account
You are responsible for keeping your account credentials (including control panel and portal logins) confidential, for all activity that occurs under your account, and for keeping your contact and billing information accurate and current. Notify us immediately at contact@dataguys.co if you suspect unauthorized use of your account.
4. Acceptable use
You may not use DataGuys services to:
- send unsolicited bulk email (spam) or operate open mail relays;
- host, distribute, or link to malware, phishing pages, or fraudulent content;
- store or transmit content that is illegal under United States or applicable state law, including content that infringes the intellectual-property rights of others;
- attack, probe, or disrupt other systems or networks, or interfere with other customers’ use of our services;
- consume system resources in a way that materially degrades the service for others (for example, sustained CPU/RAM abuse, cryptocurrency mining on shared plans, or using a hosting account primarily as a file-distribution or backup dump).
This list is a summary; our full Acceptable Use Policy governs what you may host and do on our network and is incorporated into these Terms. We may suspend or remove content or accounts that violate that policy. Where practical, we will warn you first — but we may act immediately when a violation endangers the network, other customers, or third parties. We respond to claims of copyright infringement in accordance with our DMCA policy.
5. Payments, billing, and renewals
Prices are listed in USD. The first term of every product is billed at checkout. Recurring products (hosting, email, security, care plans) renew automatically at the end of each term at the then-current renewal price shown at purchase; we send renewal notices to your account email before charging. You can cancel renewal at any time before the renewal date. If a payment fails or is overdue, we send renewal notices before and on the due date; if a renewal remains unpaid past its due date, the affected services may be suspended automatically after a grace period (currently seven days) and are reactivated automatically when the outstanding balance is paid. Accounts substantially past due may be terminated and their data removed after further notice.
6. Money-back guarantee and refunds
Hosting plans (Web Hosting, WordPress Hosting, Hosting Plus, and VDS) carry a 30-day money-back guarantee: cancel within 30 days of first purchase for a full refund of the hosting fee. The guarantee applies to a plan’s first purchase, not to renewals. Domain registrations, transfers, and renewals are non-refundable once submitted to the registry. Website design projects are non-refundable once design work has been delivered; deposits for work not yet started are refundable. 7. Domain registrations
Domain registrations and transfers are processed through our registrar partner and are subject to the registrar’s registration agreement and ICANN policies, including the ICANN Registrants’ Rights and Responsibilities. Domain pricing varies by TLD and is shown at the time of registration. You are responsible for keeping registrant contact information accurate (an ICANN requirement) and for renewing your domains on time.
8. Website design services
Website design packages include a one-time build fee and a managed care plan. Promotional pricing (including the 50%-off promotion) applies to the one-time build fee only; care plans are not discounted and are not marked up to offset the promotion. Promotional rates are time-limited, and the rate shown when you approve your build is the rate you pay. Upon full payment of the build fee, you own your website and your domain outright — if you leave DataGuys, we will hand over your site files and unlock your domain for transfer. The care plan keeps your site hosted and maintained; it is not a condition of owning it.
Every new website build includes a managed care plan covering hosting, SSL, security, backups, and support. The care plan is required, not optional. It begins on the day your site goes live and runs for a minimum term of twelve (12) months from that date. After those first twelve months it continues to renew on that plan’s own billing cycle — monthly for most packages, yearly for Premium, as stated on the package — and you may cancel it at any time from then on, effective at the end of the current billing period. This twelve-month commitment is the one exception to the cancel-any-time renewal terms in sections 5 and 11, and it applies only to the care plan attached to a new website build.
The build fee and the care plan are billed separately: the care plan is not charged at checkout alongside the build fee, and its first charge is due once your site is live. Each package has its own care plan, billed on the recurring term and at the price quoted to you at the time of sale for the package you bought.
9. Backups and your data
We run the server-side backups described in your plan on a best-effort basis, and they have saved many customers’ sites. They are not a substitute for your own backups: you are responsible for maintaining independent copies of your content and data. We are not liable for data loss beyond restoring the most recent available backup.
10. Service level
We commit to 99.9% uptime, measured monthly and excluding scheduled maintenance (announced in advance) and events outside our control. If we miss that mark in a given month, contact us within 30 days and we will credit your account with a prorated amount for the affected service. Credits are the exclusive remedy for downtime and do not apply to circumstances caused by your own applications or configuration. 11. Suspension and termination
You may cancel any service at any time from your account or by contacting us. We may suspend or terminate services for violation of these Terms, non-payment, legal requirement, or risk to our network or other customers. Except where prohibited by the circumstances, we will give you notice and a reasonable opportunity to retrieve your data before deletion.
12. Disclaimers and limitation of liability
Except as expressly stated in these Terms, services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, DataGuys’ total liability for any claim arising out of the services is limited to the amount you paid us for the affected service in the twelve (12) months before the claim arose, and we are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data.
13. Governing law
These Terms are governed by the laws of the state in which DataGuys.co LLC is organized, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in the county and state in which DataGuys.co LLC is organized, and you consent to their jurisdiction.
14. Changes to these terms and our services
We may update or change these Terms — and our services, features, plans, and pricing — at any time. When we update the Terms, we will change the “Last updated” date above and, for material changes, notify active customers by email. Continued use of the services after a change takes effect constitutes acceptance of the updated Terms.
15. Referral program
Customers who join our referral program can earn a commission when a business they refer buys from us. Taking part is optional, and it is governed by our Referral Program Terms, which apply in addition to these Terms. If you were referred to us, nothing about your services or prices changes, and the person who referred you never sees who you are or what you bought.
